End-User License Agreement for Software Product of Freemake

1. Software Licence Agreement

In this Licence, "the Product" means the software product "Freemake Video Converter" which may be found at www.freemake.com

This Licence is a legal agreement between you and Freemake for the Product.

By proceeding to install the Product, and in consideration of your use of the Product, you are deemed to agree to be bound by the terms of this Licence.

Freemake permits you to use the Product only in accordance with the terms of this Licence and your rights under this Licence will terminate automatically without notice if you fail to comply with the terms of this Licence.

2. Product Licence

In consideration of your agreeing to abide by the terms of this Licence and subject to your compliance with the terms of this Licence, Freemake grants you a non-exclusive, non-transferable licence to use the Product for the following purposes and in the following manner:

You may:
1. Install and use the Product free of charge for personal, educational (non-profit) use. In these cases, you are granted the right to use and to make an unlimited number of copies of this software.
2. Embed video player onto your website created by Freemake Video Converter software with a reference to www.freemake.com either using a template reference or a custom "courtesy of" message.

You may not:
1. Use the Product for commercial use. Instead, obtain Business License.
2. Remove any proprietary notices or labels from the Product.
3. Reverse engineer, decompile, disassemble or make derivative works based on the Product (except and only to the extent that such activity is expressly permitted by applicable law notwithstanding this limitation).
4. Rent, lease, sublicense or assign the Product or any copy thereof, including any related documentation.

3. Additional Terms for Businesses

Where you are licensing the Product as a business and not as a consumer, this licence shall take effect between Freemake and you as a business entity and you shall take all appropriate steps to ensure that the Product is operated in a proper manner by your employees and staff.

4. Intellectual Property Rights

The Product is intellectual property of Freemake and is protected by law. You acknowledge that all intellectual property rights in the Product anywhere in the world belong to Freemake, that rights in the Product are licensed (not sold) to you, and that you have no rights in, or to, the Product other than the right to use them in accordance with the terms of this Licence.

5. Warranty Disclaimer

THIS PRODUCT AND ANY RELATED DOCUMENTATION is PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES OR MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NONINFRINGEMENT. THE ENTIRE RISK ARISING OUT OF USE OR PERFORMANCE OF THE PRODUCT REMAINS WITH YOU.

6. Limitation of Liability

IN NO EVENT SHALL FREEMAKE BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION, OR ANY OTHER PECUNIARY LOSS) ARISING OUT OF THE USE OR OF INABILITY TO USE THE PRODUCT.

7. Additional Components

The Product may offer additional paid options like Freemake Video Converter Mega Pack.

The Pack is a set of additional not obligatory features for Freemake Video Converter. A user is free to choose if he/she needs to buy any of the Packs. By proceeding to buy the Pack, and in consideration of your use of the Pack, you are deemed to agree to be bound by the terms of this Licence.

One Pack key can be activated on one PC/laptop only. To activate Packs on multiple computers, you should buy more keys.

Any Pack can be refunded according to the terms of the Refund Policy.

Any questions concerning Freemake Packs should be addressed at support.freemake.com.

Freemake Video Converter contains an option: users might upload videos to their own YouTube channels using the Product interface. To upload a video to YouTube via Freemake Video Converter, you have to login with your own YouTube account credentials in the Product interface. By using the YouTube upload option in the Product, users are agreeing to be bound by the YouTube Terms of Service: https://www.youtube.com/t/terms, https://www.youtube.com/howyoutubeworks/policies/community-guidelines/. If you disagree with the YouTube Terms of Service, please do not upload videos to YouTube from the Product interface.

Please note that users, who use the YouTube upload option in Freemake Video Converter, can revoke access or delete stored data through this link https://security.google.com/settings/security/permissions.

8. General

- Updates may be licensed to you by Freemake with additional or different terms but Freemake has no obligation to provide any updates.

- This Licence is the entire agreement between you and us and supersedes any prior representations, undertakings or advertising relating to the Product and you acknowledge that in entering into this Licence you have not relied on any statement, representation, advertising, assurance or warranty (whether made negligently or innocently) other than as expressly set out in this Licence.

- This terms are subject to change without notice. Visit our site www.freemake.com and download software to get the most recent End User License Agreement.

9. Collection of statistics

We have a lot of features and improvements to work on. Help us prioritize them all by permitting Freemake software to send anonymous crash and usage statistics reports. We collect information about using the installer during installation phase and information about used application functions while using Freemake Video Converter. FreemakeUtilsService sends reports when the application is not working properly and crashes.

Usage statistics reports contain information about most common tasks, preferred websites, conversion formats, etc. It does not include downloadable and converted file names. WE DO NOT COLLECT ANY PERSONAL INFORMATION, including your email addresses, logins, passwords, IP addresses, visited webpages, your location or contact information. Please read our Privacy Policy.

Crash reports contain system information at the time of the crash, error type, file details referred to the crash. Before sending a crash report, you can view it.
